Advocacy of European Rules of Competition

Research paper from the module team members! Nataliia Mazaraki and Anzhelika Gerasymenko have published the results of a study on the substantiation, interpretation and application of the criterion of full-functional economic activity in EU competition law. The EU Acquis is the donor of the recent amendments to Article 22 of the Law of Ukraine "On Protection of Economic Competition", so the authors sought to clarify the peculiarities of merger control with regard to this criterion and to analyze the practice of the European Commission.

On September 8, 2023, the project "Competition and State Aid Rules and Practices Alignment with the EU Acquis (COMPASA)" was officially launched online, and will be active until 2026. The project will be implemented by a consortium consisting of WYG Consulting and the Romanian Competition Council on the basis of the Antimonopoly Committee of Ukraine.

The event was attended by the performers of the Jean Monnet projects of SUTE, in particular, Professor Ganna DUGINETS and Professor Anzhelika GERASYMENKO (project "Advocacy of European Rules of Competition"), as well as Associate Professor Larysa LEBEDEVA (project "EU Economic resilience policy"). The project focuses on two main issues: competition, which includes antitrust and merger control, and state aid, the reliable control of which will contribute to the development of Ukraine's economy. In addition, the COMPASA project is a platform for an open and effective dialogue between the authorities and representatives of the education sector and the domestic business community.

The cooperation of SUTE representatives within the COMPASA project will improve the knowledge and competencies of the culture of fair competition among students of different educational levels studying at the University, as well as contribute to updating the practical components of SUTE Jean Monnet projects.

THE FOURTH MODULE OF THE PROJECT "ADVOCACY OF EUROPEAN COMPETITION RULES" IN VINNYTSIA

For the first time since the start of the full-scale Russian invasion of Ukraine, the educational and scientific module "Advocacy of European Competition Rules" was held in an offline format at the Vinnytsia Institute of Trade and Economics of DTEK. The event, which took place on July 10-14, 2023, was attended by 67 students interested in gaining additional knowledge of European competition rules and the prospects for their application in the context of Ukraine's accession to the EU. The participants included representatives of not only the academic community of Vinnytsia region, but also of small businesses and civil society of the region.

At the end of the module, the project coordinator, Professor Ganna Duginets, held a master class on the specifics of preparing a project application under the Jean Monnet Erasmus+ Program.  We hope that next year, representatives of the Vinnytsia Institute of Trade and Economics of DTEK will be among the lwinner’s list of the program.

THE  THIRD MODULE OF THE JEAN MONET PROJECT "ADVOCACY OF EUROPEAN RULES OF COMPETITION"

On April 03-07, 2023, SUTE hosted the Third Module of the Jean Monnet Project "Advocacy of European Rules of Competition", which was attended by 45 participants from the academic community, civil servants, and small business representatives. Given the online format of the event, representatives from different regions of Ukraine – Lviv, Kyiv, Kharkiv, Cherkasy, Ivano-Frankivsk, and others – have taken part in the module.  

The implementation of the next stage of the project is another step towards developing a culture of competition to improve the quality of business cooperation between Ukraine and the EU.

THE SECOND MODULE OF THE JEAN MONET PROJECT "ADVOCACY OF EUROPEAN RULES OF COMPETITION"

On October 10-14, 2022, SUTE hosted the Second Module of the Jean Monnet Project "ADVOCACY OF EUROPEAN RULES OF COMPETITION", which was attended by 37 participants from the academic community, civil servants, as well as representatives of small and medium-sized businesses. It should be noted people from different regions of Ukraine took part in the module: from Lviv, Odesa, Kyiv, Zhytomyr, Ivano-Frankivsk, etc.

THE FIRST MODULE OF THE JEAN MONET PROJECT "ADVOCACY OF EUROPEAN RULES OF COMPETITION"

On July 18-22, 2022, SUTE hosted the first module of the Jean Monet Project "Advocacy of European Rules of Competition", which was attended by 40 participants from the academic community and civil servants. Among the latter are representatives of the Office of the President of Ukraine, the Antimonopoly Committee of Ukraine, the Ministry of Economy of Ukraine, and the National Agency Corruption Prevention. It should be noted, that the participants represent different regions of Ukraine - Lviv, Dnipro, Zaporizhzhia, Odesa, Vinnytsia, Kyiv, Uzhgorod, Kharkiv, Kryvyi Rih, Ivano-Frankivsk, Rivne, Ternopil, etc.

PRESENTATION OF THE AERC PROJECT AMONG INTERNATIONAL PARTNERS

On June 21, 2022, during an official visit to the Ljubljana School of Business (Slovenia), Professor Angelika Gerasimenko presented to our Slovenian partners the Jean Monnet project "Advocacy of European Rules of Competition", which is being implemented at SUTE, and a teaching course with the same name that is developed within the project’s framework. The presentation was received favorably. In the following lively discussion, the priorities set by the organizers were validated, and the importance of acquiring knowledge about the rules of competition, for professionals (entrepreneurs, civil servants, the academic community) and for other interested parties.

THE RESULTS OF THE SURVEY ON THE INTEREST TO MASTER EUROPEAN RULES OF COMPETITION

Since 04 April till 14 April 2022 the project team of Jean Monnet Project 101047657 – AERC – ERASMUS-JMO-2021-HEI-TCH-RSCH “Advocacy of European rules of competition” conducted the survey on the interest to master European rules of competition. 173 respondents participated in the survey. Among them were 40 students, 50 academics, 37 state officers and 46 representatives of entrepreneurial environment all over Ukraine. The most active were the residents of the Central Ukraine, while the least one – residents of the South and East of Ukraine, which at the moment of conducting the survey were occupied by the russian troops. The latter restricted the access of the respondents to the survey, however the answers we have got testify the interest of Ukrainian auditory to the competition issues and their wiliness to master European rules of competition.

Only two respondents among 173 pointed that they have never met a phenomenon of economic competition, while almost 40% of the respondents said that they met it often, 33.5% – from time to time.

Only 22.5% of the respondents told that they could differ competitive practices from anticompetitive one, while 17.3% of them usually could not do it. More than 60% of the respondents differed them instinctively from time to time. That means the need for explaining the nature competitive and anticompetitive behavior within each of target groups.

11% of the respondents pointed that they were aware about the European rules of competition, 40.5% of them knew some of the rules, while almost a half of the respondents did not know these rule at all.

Only 4 respondents told that they needed no additional knowledge about European rules of competition and were not interested in the educational course. 97.7% of the respondents acknowledged them interested in the course and deeper knowledge on European rules of competition and competition culture.

The survey illustrated the interest of the Ukrainian auditory to a wide range of the competition issues. The least significant was the interest to the matter of evolution of Europeans rules of competition (13.4%, excluding those who pointed the interest to all the issues proposed). The most significant was the interest to perspectives of applying of European rules of competition in the postwar economy of Ukraine. The survey contained the open answer to this question. There were 5 open answers submitted. Each of them asked about the practical skills of applying of European rules of competition. It will be definitely included into the course.

RESEARCH OF THE DEMAND OF UKRAINIAN SOCIETY FOR MASTERING THE EUROPEAN RULES OF COMPETITION

The first step to develop such a course is to research the current level of competition culture in Ukrainian society and to learn the demand of Ukrainian students, academics, entrepreneurs and state officers for mastering European rules of competition. The results of the survey will underlie the educational course on the advocacy of European rules of competition that will be conducted through the modules under Jean Monnet Project 101047657 – AERC – ERASMUS-JMO-2021-HEI-TCH-RSCH “Advocacy of European rules of competition” within a timeline of the project and within the distinct educational course in the State University of Trade and Economics after the timeline of the project.
